Terms of Service — Clock It

These Terms of Service ("Terms") govern your use of the Clock It mobile application ("the App"), provided by the developer of Clock It ("we", "us"). By downloading or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age in your jurisdiction) and able to form a binding contract to use the App.
2. The service
Clock It is a "chaos alarm" designed to make waking harder to sleep through — it can fire at a random time within a window around your set time, plays varied wake sounds, and gates dismissal behind a wake-up "mission". An optional microphone-based sleep sampler is also available.
3. ⚠️ No guarantee of waking — important safety notice
Clock It is provided "as is" and is not a guaranteed wake-up service. Alarm delivery depends on factors outside our control, including your device's operating system, notification and Focus/Do Not Disturb settings, volume, battery, network, and background-app limits. Do not rely on Clock It as your sole or primary means of waking for any safety-critical or time-critical situation (for example, work, travel, medical, or other circumstances where failing to wake could cause harm or loss). Always use a backup alarm for anything important. By using the App you accept this limitation.
4. Accounts
You are responsible for activity under your account and for keeping your sign-in method secure. You agree to provide accurate information and to notify us of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
5. Subscriptions, Premium, and the Emergency Pass
Clock It Premium is an auto-renewing subscription offered as Annual, Monthly, and Weekly plans. The Emergency Pass is a one-time, non-renewing consumable that grants a single morning of premium behaviour.
- Billing. Purchases are processed by Apple through your App Store account. Prices are shown in the App before purchase.
- Auto-renewal. A subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. You manage and cancel subscriptions in your App Store account settings, not within the App. Deleting the App does not cancel a subscription.
- Free trials / introductory offers, if offered, are described at the point of purchase; any unused portion of a free trial is forfeited when you purchase a subscription.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies; we generally cannot issue refunds directly.
6. Free tier and advertising
The free tier is supported by advertising. By using the free tier you agree we may display ads (we request non-personalised ads). Upgrading to Premium removes ads.
7. Acceptable use
You agree not to: reverse engineer, decompile, or tamper with the App or our backend; attempt to gain unauthorised access, manipulate your subscription entitlement, or disrupt the service; use the App unlawfully or to infringe others' rights; or upload unlawful or harmful content. We may suspend access for violations.
8. User content
Some features (e.g. wake-up photo missions) involve content you create. You retain ownership of your content and grant us a limited licence to process it solely to provide the features you use.
9. Intellectual property
The App, its design, branding, and content (excluding your content) are owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App under these Terms.
10. Disclaimers
To the fullest extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that alarms will always fire as intended (see Section 3).
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, or for any failure of an alarm to fire, arising from or related to your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your misuse of the App or violation of these Terms, to the extent permitted by law.
13. Changes to the App and Terms
We may modify or discontinue features at any time. We may update these Terms; for material changes we will update the "Last updated" date and provide notice in the App. Continued use after changes means you accept the updated Terms.
14. Termination
You may stop using the App at any time and delete your account from within it. We may suspend or terminate your access for violations of these Terms or where required by law.
15. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of India, unless mandatory consumer-protection law in your country of residence provides otherwise — nothing in these Terms removes rights you have under the mandatory consumer law of your own country.
16. Apple-required terms
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Maintenance, support, and warranty claims (if any) are our responsibility, not Apple's, to the extent required by Apple's standard EULA, which also applies.
